Terms of Service

Coal - Northplay ApS - Last updated:

These Terms govern access to and use of Coal, a software service for studios and publishers that connects marketing actions to Steam wishlist outcomes.

Who We Are

Coal is provided by Northplay ApS, UNIVATE, Njalsgade 76, 4., Office A4-55, 2300 Copenhagen S, Denmark, CVR 37649090. Contact: hey@northplay.co.

The Service

Coal is a Wishlist Growth Platform for Steam games. It helps approved customers connect data sources, track marketing activity, monitor social and Radar signals, and measure wishlist impact. Product features may change as the service evolves.

Access Model

Coal is currently available to selected partners and customers rather than open public signup. We may approve, deny, suspend, or limit access at our discretion, including for security, capacity, compliance, or business reasons.

Accounts and Authorized Users

You must provide accurate information and protect your credentials. If you use Coal on behalf of an organization, you represent that you are authorized to bind that organization and use its connected accounts, data sources, and project information.

Customer Responsibilities

You are responsible for:

Acceptable Use

You may not misuse Coal, attempt unauthorized access, interfere with service operation, upload malicious content, connect accounts you do not control, violate platform policies, or use Coal to process data in a way that violates law or third-party rights.

Third-Party Services

Coal may interoperate with services operated by third parties. We do not control those services and are not responsible for their availability, data accuracy, API changes, policies, or actions. Your use of third-party integrations is governed by the terms and policies of those providers.

Customer Data

You retain rights to your customer data, subject to third-party rights in underlying content. You grant Coal the rights needed to host, process, transmit, display, analyze, and back up that data solely to provide and improve the service, support customers, maintain security, and comply with law. Personal data handling is described in the Privacy Policy.

Fees and Paid Access

Coal may be provided under a separate order form, subscription, pilot, partner arrangement, or other written agreement. If a separate agreement conflicts with these Terms, the separate agreement controls for that customer relationship.

Intellectual Property

Coal, including its software, design, product names, and branding, is owned by Northplay ApS or its licensors. These Terms do not transfer ownership. You receive a limited, non-exclusive, non-transferable right to use Coal as made available to you.

Confidentiality

The private Coal dashboard, non-public product functionality, customer data, credentials, pricing, and integration setup may be confidential. You must protect confidential information and use it only for the purpose of using or evaluating Coal.

Availability and Changes

We aim to operate Coal reliably, but the service may be unavailable because of maintenance, infrastructure issues, third-party API changes, or events outside our control. We may modify, add, or remove features at any time.

Disclaimers

Coal is provided on an "as is" and "as available" basis to the fullest extent permitted by law. We do not guarantee uninterrupted operation, error-free results, or that analytics will capture every relevant marketing or wishlist effect.

Limitation of Liability

To the fullest extent permitted by law, Northplay ApS will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost goodwill, or lost data. Our aggregate liability is limited to the amount paid for Coal in the twelve months before the claim, or DKK 1,000 if no fees were paid, unless a separate written agreement states otherwise.

Termination

You may stop using Coal at any time. We may suspend or terminate access if you breach these Terms, create risk for the service or other customers, fail to pay applicable fees, or if required by law. Sections that should reasonably survive termination will continue to apply.

Governing Law

These Terms are governed by the laws of Denmark, without regard to conflict-of-law rules. Courts in Copenhagen, Denmark have exclusive jurisdiction, except where mandatory law requires otherwise.

Changes to Terms

We may update these Terms. The latest version will be posted at coal.nexus/terms. Continued use after changes means you accept the updated Terms.

These Terms are provided for operational use and are not legal advice.
